Recently, Senator Patrick Leahy (D-VT) introduced the Combating Online Infringement and Counterfeiting Act (COICA). If enacted, this legislation would require the Attorney General to compile a list of websites suspected of copyright infringement. Furthermore, the Department of Justice would have the power to shut down website it determines are dedicated to infringing activity.
While I am troubled about the spread of online counterfeiting, like you I have concerned about the new powers this bill would give the federal government. We must be careful that as we work to battle online crime, we do not abandon the free and open approach to the Internet that has spurred innovation.
You will be pleased to know that at this time, it does not appear likely that COICA will be considered by this Congress. Nonetheless, should you have any additional questions or comments, please do not hesitate to let me know.
